STATEMENT OF INTERNATIONAL JURISTS CONFERENCE ON EAST TIMOR

Dublin, 10 November 1996

The participants of the international jurists conference on East Timor,

Affirm that the Indonesian invasion and occupation of East Timor constitute blatant and gross violations of international law of self-determination, human rights and humanitarian law and;

Deplore the recent decision of the Government of Malaysia to deport the Adelaide Phd development economics student Helder da Costa to Indonesia in clear breach of its international obligations to return him to his port of departure in Australia and;

Propose that the following initiatives be undertaken by the Irish government in the last weeks of their presidency of the European Union with the aim of advancing a just and peaceful settlement to the question of East Timor,

1. That the European Union undertake arrangements to ensure the ongoing monitoring and reporting on the situation in East Timor, with a view to achieving the ultimate goal of the self-determination of the East Timorese people.

2. That the Council of Ministers, acting pursuant to Articles 1 and 2 of its Common Position made public in June 1996, take immediate action to halt military assistance and arms sales to Indonesia, thus reinforcing the resolution of the European Parliament on 20 June 1996.

3. That the Council of Ministers resolves that all Member States and European Union agencies continue their non-recognition of Indonesian annexation of East Timor and refrain from any action or dealing that might be interpreted as a direct or indirect recognition of the annexation. Further to request that the European Parliament pass a resolution in the same terms.

4. That the Council of Ministers, acting pursuant Articles 1 and 2 of its Common Position made public in June 1996, immediately calls on the Government of Indonesia to conclude a Memorandum of Understanding with the UN High Commissioner for Human Rights for the deployment of a UN human rights officer in Dili, East Timor.

5. That the European Union call for the immediate and unconditional release of the East Timorese leader Xanana Gusmão, to enable him to participate in the ongoing United Nations sponsored talks and all other political prisoners currently in Indonesian gaols.
